The court finds the record shows the employer took the appropriate action to address his complaints regarding the behavior. The court subsequently orders the litigant to show cause as to why it should exercise jurisdiction over his state law claims, including his common law assault and battery claims.

Alley finds a lower court erred in denying a state agency’s plea to the jurisdiction after it was sued by an employee whom it said was fired for assaulting another coworker but who argued that in fact the real reason for her firing was discrimination. Regardless, the employee has failed to provide adequate evidence that the stated “nondiscriminatory reason” for her firing was pretextual. Affirmed.

Morrison enters partial judgment in favor of JetBlue Airways on an employment discrimination brought by an inflight crewmember who alleges she was sexually assaulted by a male crewmember at a hotel during a layover in San Francisco. The airliner cannot be held liable for aiding and abetting a hostile work environment violation by an employee, and one of her state law hostile work environment claims fails to allege the airliner acted in bad faith when it conducted its investigation into her allegations. The court, however, concludes a jury could find the airline’s response to her allegations was inappropriate due to the circumstances and preserves three additional claims for hostile work environment for trial.

The committee failed to perform proper duties and did do them with a discriminatory intent. The county’s motion to dismiss is denied in full.
